Terms of Service

These Terms of Service ("Terms") are a contract between you and Makazi Holdings Ltd ("Makazi", "we", "us"), the company that operates makazi.app. By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Makazi.

Makazi is an online marketplace and intermediary. We connect people looking for homes with the agencies and private owners who list them, and we connect users who want legal help with independent advocates.

We are not, and do not act as:

• the landlord, seller, or owner of any property listed;
• your estate agent or a party to any tenancy or sale you enter;
• a law firm. Advocates on Makazi are independent practitioners.

Listings, prices, and property details are provided by third parties. Our verification, such as EARB checks on agencies, reduces risk but is not a guarantee of any listing, person, or transaction. Always do your own due diligence before paying money or signing anything.

You must be at least 18 and able to enter a contract under Kenyan law. Keep your account details accurate and your credentials secure. You are responsible for activity under your account. Tell us promptly at info@makazi.app if you suspect unauthorised use.

When using Makazi you agree not to:

• post false, fraudulent, or misleading listings or information;
• impersonate others or misrepresent your authority to list a property;
• scrape, harvest, or bulk-extract data, or interfere with the service's security or operation;
• use Makazi for anything unlawful, including offences under the Computer Misuse and Cybercrimes Act 2018.

We may remove content and suspend accounts that breach these Terms.

If you list a property, you confirm you have the right to do so and that your information is accurate and lawful. You grant Makazi a licence to display that content on the platform. You are responsible for your listings and for complying with all applicable laws, including landlord and tenant law and tax obligations.

Where Makazi helps you reach an advocate, the resulting advocate and client relationship is between you and that advocate, on the terms you agree with them. Makazi facilitates the introduction and any agreed payment. We do not provide legal advice and are not responsible for the advice given or the outcome of any matter.

Paid services are processed by our payment partner, Paystack. You agree to pay the fees shown at checkout. Applicable taxes may be added. Refunds, where offered, follow the terms shown at the point of purchase. We keep transaction records as required by Kenyan tax law. See the Privacy Policy.

The Makazi platform, brand, and software are owned by Makazi. These Terms do not transfer any of our intellectual property to you. Content you submit remains yours, and you grant us the licence needed to operate and promote the service.

Makazi is provided on an "as is" and "as available" basis. We do not warrant that listings are accurate or that any transaction will succeed. Nothing in these Terms removes or limits rights you have under the Consumer Protection Act 2012 or other Kenyan law that cannot be excluded by agreement.

To the fullest extent permitted by law, Makazi is not liable for indirect or consequential loss, or for the acts of third parties such as agencies, owners, advocates, or payment providers. Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.

You may stop using Makazi at any time and delete your account. We may suspend or end access if you breach these Terms or where we need to protect users and the service.

These Terms are governed by the laws of Kenya. We would like the chance to resolve any problem first, so please contact us at info@makazi.app. If we cannot resolve it, disputes may be brought before the courts of Kenya. Nothing in these Terms takes away your right to go to court.

We may update these Terms as the service evolves. When we make material changes we will update the version and date above and, where appropriate, notify you. If you keep using Makazi after a change, that means you accept the updated Terms.
